LAST WILL AND TESTAMENT ATTORNEYS IN OKLAHOMA CITY

Wills

A will or Last Will and Testament is a legal document directing the disposition of property and assets upon death. In the will, you name an individual who will be responsible for carrying out your wishes and distributing your assets. This person is referred to as the executor or personal representative. If you have minor children, your will should identify the individuals you wish to serve as guardians of your children.

In order for a will to have any effect, the will must be admitted to probate. Probate is a court proceeding in which the Judge determines the heirs and the validity of the will, if any. The Court will oversee the process of distributing the assets of the deceased person.

The Oklahoma statutes set forth formal requirements for the execution of wills in Oklahoma. Some individuals may wish to prepare their own will. Creating your own will brings risk that can have lasting effects. A will must clearly and unambiguously state an individual’s wishes and also provide for contingencies. An experienced estate planning attorney will provide invaluable advice concerning many decisions involved including, appointing a guardian for your children, naming a personal representative and the manner in which distributions will be made. Your attorney will document your intent and state of mind at the time your will is signed, which is important if disputes later arise.

To ensure your will meets legal requirements, is properly executed and clearly expresses your wishes, you should consult an experienced estate planning attorney.
