What does the divorce process look like?

The divorce process will look different depending on your circumstances, but there are some basic things you can expect.

  • First, the filing party must meet residency requirements. The filing party must have been a resident of the county in which they filed for a minimum of 30 days and a resident of Oklahoma for a minimum of six months.
  • The filing party must decide whether they want to pursue a no-fault or a fault-based divorce since a no-fault divorce has a mandatory separation period.
  • If the divorce is uncontested, it can be finalized after ten days. If it is contested, hearings regarding child custody and asset division can lengthen the process significantly. 
How much does divorce cost?

The cost of divorce varies. Things like the presence of minor children in the household, contention between parties, the division of assets, and whether the divorce is fault or no-fault can change the cost of the divorce process. 

How often will my attorney communicate with me?

Your attorney will actively communicate with you throughout your divorce proceedings. We will help you prepare for hearings, let you know about changes in your case, let you know if we need documents or other materials from you, and keep you up to date about billing. 

What information will my attorney need from me?

The required documentation can vary by case, but these are some common documents your attorney might need: 

  • Financial documents relating to shared assets and income 
  • Documents relating to minor children like birth certificates and custody agreements already in place 
  • Your personal information such as contact details, employment information, and addresses 
  • Titles of property 
  • Documents you have been served with relating to the divorce such as a petition or summons 
Is what I tell my attorney confidential?

How long can I expect the divorce process to take?

The length of a divorce depends on many factors. An uncontested divorce of a couple with no minor children can be finalized in as little as 10 days. However, if the custody and visitation agreements prove to be contentious or if the shared assets are relatively complex, the divorce could take as long as a year or more.
