Damages You Can Recover In Wrongful Death Cases


There are two types of damages that you can pursue in a wrongful death case in the state of Oklahoma. First, you can sue for the damages incurred by the deceased that he or she could have pursued in a personal injury case. These include damages for:

  • Pain and suffering which took place between the time of injury or illness and death; and
  • Forfeiture of income or benefits the deceased should have earned if he or she had lived

Secondly, a family may sue for damages that represent the burdens they suffer with as a result of losing a loved one. This may involve compensation for grief and loss of companionship, as well as the financial harm resulting from the loss of their loved on whom they depended on.

 

Oklahoma Law Regarding Wrongful Death


Oklahoma Statutes Title 12, Section 1053 defines a wrongful death as an incident “when the death of one is caused by the wrongful act of another.” Wrongful act refers to someone’s reckless, negligent, or even intentional act that led to the individual’s death. A wrongful death case is not the same as a criminal case for murder; if the defendant is also tried for murder, the wrongful death case will remain separate. This ensures that even if the individual is found “not guilty” in the criminal court; the victim’s family can still recover compensation for their loss.

Oklahoma legislation permits the “personal representative” of the departed person’s estate to submit a wrongful death claim to court. The personal representative both represents the deceased and also the beneficiaries or heirs of the deceased. This person can be appointed according to the deceased’s will or estate plan or can be appointed by the court. This is the person who will be eligible to file a wrongful death claim.
